Welcome to AB. These Terms of Use ("Terms") govern your access to and use of the AB website, mobile application, and related services (collectively, the "Services") operated by AB ("AB", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. General Provisions

1.1 AB provides a premium luxury chauffeur service connecting passengers with professional chauffeurs through our digital platform. These Terms establish the legal framework for your use of our Services.

1.2 By creating an account, booking a ride, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.3 We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the platform at least 30 days before they take effect. Continued use of the Services after such changes constitutes acceptance of the updated Terms.

2. Eligibility

2.1 The Services are available to individuals who are at least 18 years of age and possess the legal capacity to enter into binding agreements in their jurisdiction.

2.2 You represent and warrant that all information you provide during registration and throughout your use of the Services is accurate, current, and complete. You agree to update your information as necessary to maintain its accuracy.

2.3 AB reserves the right to refuse service, suspend accounts, or terminate access at its sole discretion, including in cases of suspected fraud, abuse, or violation of these Terms.

3. Modification of Terms

3.1 AB may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will provide notice of material changes through the Services or via email.

3.2 Your continued use of the Services following the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Services and terminate your account.

3.3 It is your responsibility to review these Terms periodically. We recommend checking this page regularly for updates.

4. Arbitration Agreement

4.1 Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be resolved through binding arbitration, rather than in court, except for claims that may be brought in small claims court.

4.2 The arbitration shall be conducted by a neutral arbitrator under the rules of the International Chamber of Commerce (ICC). The place of arbitration shall be Riyadh, Kingdom of Saudi Arabia. The language of arbitration shall be English.

4.3 You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

4.4 Notwithstanding the above, AB may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

5. Payment

5.1 All fares, fees, and charges for rides are displayed in the application at the time of booking. Prices may vary based on vehicle class, route, distance, duration, time of day, and applicable taxes or surcharges.

5.2 Payment is processed through the payment method linked to your AB account. You authorize us to charge your selected payment method for all applicable fees upon completion of each ride.

5.3 For corporate accounts, payment terms and billing cycles are specified in the applicable corporate agreement. Late payments may incur interest charges of 1.5% per month or the maximum rate permitted by law.

5.4 All prices are exclusive of applicable taxes, which will be itemized on your receipt. Refund requests must be submitted within 14 days of the ride date and are subject to review.

9. Indemnity

9.1 You agree to defend, indemnify, and hold harmless AB and its officers, directors, employees, contractors, agents, licensors, suppliers, and affiliates from and against any claims, actions, demands, liabilities, damages, losses, costs, and expenses arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

9.2 AB reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you shall cooperate fully with AB in asserting any available defenses.

10. Force Majeure

10.1 AB shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, government actions, war, terrorism, strikes, road closures, severe weather conditions, or infrastructure failures.

10.2 In the event of a force majeure occurrence, AB will use commercially reasonable efforts to resume performance as soon as practicable and will provide timely updates to affected users.

11.3 Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply, including provisions regarding payment, intellectual property, limitation of liability, indemnification, and dispute resolution.
